1. Acceptance of Terms

By accessing the Care Ride Share Club website, creating an account, or becoming a member, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use our services. These Terms constitute a legally binding agreement between you and Care Ride Share Club (ABN pending).

2. About the Club

Care Ride Share Club is a member organisation that arranges group protection benefits for rideshare drivers operating in Australia. We are not an insurance company, insurance broker, or financial adviser. Protection coverage is arranged through licensed underwriting partners.

3. Eligibility

To be eligible for membership, you must:

• Be at least 18 years of age
• Hold a valid Australian driver’s licence
• Be actively engaged in rideshare, taxi, or private hire driving in Australia
• Provide accurate and complete information during registration
• Have a vehicle registered in Australia that meets applicable safety standards

4. Membership

4.1 Registration

Upon registration, you will receive a personalised membership quote based on the information you provide. Membership becomes active upon payment of your first subscription instalment, subject to any applicable waiting period.

4.2 Waiting Period

New memberships are subject to a 14-day waiting period from the date of activation. During the waiting period, certain benefits may not be available. Emergency roadside assistance is available immediately.

4.3 Membership Certificate

Upon activation, you will receive a digital membership certificate confirming your membership status, plan, and validity dates. This certificate must be presented upon request when making a claim.

5. Payments and Billing

5.1 Subscription

Membership fees are billed on a recurring monthly basis via the payment method on file. All prices are in Australian dollars (AUD) and include GST where applicable.

5.2 Failed Payments

If a payment fails, we will attempt to collect payment again. If payment remains unsuccessful after multiple attempts, your membership status will change to “past due” and coverage may be suspended until payment is received.

5.3 Price Changes

We reserve the right to change membership fees with 30 days written notice. If you do not agree with a price change, you may cancel your membership before the new pricing takes effect.

6. Cancellation and Refunds

6.1 Cancellation by Member

You may cancel your membership at any time with 30 days notice via your dashboard or by contacting our support team. Coverage will continue until the end of your current paid period.

6.2 Refunds

Pre-paid amounts for unused full months will be refunded to your original payment method within 14 business days. Partial months are not refunded.

6.3 Cancellation by Us

We reserve the right to cancel or suspend your membership if you breach these Terms, provide false information, engage in fraudulent activity, or fail to maintain payment for more than 60 days.

7. Member Obligations

As a member, you agree to:

• Provide accurate, complete, and up-to-date information
• Notify us of any material changes to your circumstances (e.g., vehicle change, licence suspension)
• Not misrepresent facts when making a claim
• Maintain a valid driver’s licence and vehicle registration
• Keep your account credentials secure and not share access with others
• Comply with all applicable Australian laws while driving

8. Coverage and Claims

The specific terms of any protection coverage are governed by the relevant Product Disclosure Statement (PDS) or coverage document provided by our underwriting partners. These Terms do not constitute a policy of insurance.

Claims must be submitted promptly and honestly. False or fraudulent claims will result in immediate termination of membership and may be reported to relevant authorities.

9. Limitation of Liability

To the maximum extent permitted by law, Care Ride Share Club’s liability to you for any loss or damage arising from your membership is limited to the total membership fees paid by you in the 12 months preceding the claim.

We are not liable for any indirect, incidental, or consequential damages, including loss of income, business interruption, or loss of data.

10. Intellectual Property

All content on the Care Ride Share Club website, including logos, text, graphics, and software, is owned by or licensed to Care Ride Share Club and protected by Australian intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

11. Dispute Resolution

Any disputes arising from these Terms will be resolved in the following order:

1. Direct negotiation between the parties
2. Mediation through an agreed mediator
3. Binding arbitration under the laws of New South Wales, Australia

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated to members via email at least 30 days before taking effect. Continued use of our services after changes take effect constitutes acceptance.
